By ordering any of Obermetalworks products, you agree to be bound by these terms & conditions.

By placing an order at Obermetalworks, you warrant that you are at least 18 years old or have parents' permission to buy from us. Turnaround time is between 2-6 weeks for custom orders. In stock items should ship in 1 to 3 business days from purchase date, it is recommended to contact us for items that are intended to arrive by a certain date (birthdays, anniversaries and such).

The price applicable is that set at the date on which you place your order

All prices are listed in United States Dollars.

Shipping is via USPS 1st Class in the USA, and First class worldwide.

Shipping costs and payment fees are recognized before confirming the purchase.

Please note that local charges or taxes may occur, those are the purchasers’ sole responsibility and Obermetalworks is not liable to pay or reimburse the customer in any way.

Obermetalworks will accept PayPal payments with prior notification via email; except during high traffic times, i.e. when a scheduled drop is taking place. Please use the "Contact" button to send an email with your order (screen shots of the order are preferred).

Custom orders: Obermetalworks will accept custom orders. Payment for custom orders is due within 7 days of the order’s completion.

All personal information you provide us with or that we obtain will be handled by Obermetalworks as responsible for the personal information.

Events outside Obermetalworks’ control shall be considered force majeure.

Card information is transmitted over secure SSL encryption and is not stored.

Obermetalworks reserves the right to amend any information without prior notice.

This page contains the terms & conditions. Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.

By placing an order at Obermetalworks , you warrant that you are at least 18 years old (or have parents' permission to buy from us) and accept these terms & conditions which shall apply to all orders placed or to be placed at Obermetalworks for the sale, use and/or supply of any products. None of these terms & conditions affect your statutory rights. No other terms or changes to the terms & conditions shall be binding unless agreed in writing signed by us.

Custom Orders

Custom orders are accepted. Completion times for custom work may vary based on existing work load, material availability, and force majeure. In general completion times vary from 2 to 6 weeks.

Custom Orders encompass:

Customer requested versions and variations of previous and existing work.

Replication of previous work based on material availability and requisite 3rd party components.

New designs.

One of a kind designs and materials (i.e. Damascus patters, mokume gane patterns, timascus/mokuti patterns).

Custom orders do not encompass replication in part or in whole of work by other makers/craftspeople/designers without written permission of the maker/craftsperson/designer.

Prices for custom work are determined on a case by case basis and may be affected by commodity prices (i.e. fluctuations in metals markets), material availability and price.

Obermetalworks does not require a deposit to begin custom work unless material/s require a substantial capital investment (i.e. gold, mokume gane, timascus/mokuti); the commission is a customer designed piece; the commission is of limited market appeal. Deposits for materials are non-refundable after the materials have been purchased by Obermetalworks.

Alterations on a custom order after it has been started are possible in certain situations. Depending on the nature of the alteration/s the project may be placed at the back of the order list (i.e. if the alteration requires remaking a component to different dimensions that where originally agreed upon). If the commission utilizes specialized materials alterations may not be possible and a reassessment of the commission may be needed which could result in the cancelation of the commission (if a materials deposit was required, those funds will not be re-funded if the materials have been purchased).

Custom work is generally completed on a first come first served basis unless specific parts or materials need to be ordered or there is a machine/equipment failure that prohibits the completion of a commission in the order it was received. All efforts are taken to complete custom orders in a timely fashion with the knowledge there can be forces outside of Obermetalworks control (i.e. power failures, equipment failures, etc.).

Payment is due upon completion of the work after the customer has approved the completed piece via images or other communication. Payment, in full, is due within 7 days after an invoice, PayPal address, or other payment information has been provided by Obermetalworks.

It is possible to cancel a custom order, it is best to cancel earlier rather than later. Deposits for materials for a custom are non-refundable after the materials have been purchased by Obermetalworks.

Processing an order

It takes between two (2) to six (6) weeks to process a custom order once it's been purchased, we are a small business and we handcraft all pieces ourselves, there are also instances in which an unforeseen event may happen and this may cause a delay in time. It is strongly encouraged for you, the customer to contact us for orders that are intended to arrive by a certain date or for special events; it is possible in some cases to expedite processing for orders that must be received by a certain date, but it is treated on a case by case basis, and may incur an added expense.

Shipping

Shipping is via USPS as follows:
-In the USA we ship via USPS 1st class, which means you should receive your item within 3-7 business days after its been shipped, in some cases it takes two days, in others it takes slightly more. A tracking number is generally sent via electronic communication (e-mail), however you are encouraged to contact us and request your tracking number in the event you have not received one 24 hrs after the item has been marked shipped.
-International Orders are shipped via USPS FIRST CLASS, there is no tracking on these orders, but generally there is an LC number that we utilize as proof of shipping (The LC number is for customs reasons).

Personal Information

All personal information you provide us with or that we obtain will be handled by Obermetalworks as responsible for the personal information. The personal information you provide will be used to ensure deliveries to you, the credit assessment if applicable, to provide offers and information on our catalog to you. The information you provide is only available to Obermetalworks and will not be shared with other third parties. You have the right to inspect the information held about you. You always have the right to request Obermetalworks to delete or correct the information held about you. By placing an order at Obermetalworks website, you accept Obermetalworks conditions, and you agree to the above.

Force Majeure

Events outside Obermetalworks control, which is not reasonably foreseeable, shall be considered force majeure, meaning that Obermetalworks is released from its obligations to fulfill contractual agreements. Example of such events are government action or omission, new or amended legislation, conflict, embargo, fire or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The force majeure also includes government decisions that affect the market negatively and products, for example, restrictions, warnings, ban, etc.

Local Taxes

Please note that local charges (sales tax, customs duty) may occur, depending on your region and local customs duties. These charges are at the customers own expense.

Cookies

Obermetalworks uses cookies according to the new Electronic Communications Act, which came into force on 25 July 2003. A cookie is a small text file stored on your computer that contains information that helps the website to identify and track the visitor. Cookies do no harm to your computer, consist only of text, can not contain viruses and occupies virtually no space on your hard drive. There are two types of cookies: "Session Cookies" and cookies that are saved permanently on your computer.

The first type of cookie commonly used is "Session Cookies". During the time you visit the website, our web server assigns your browser a unique identifier string so as not to confuse you with other visitors. A "Session Cookie" is never stored permanently on your computer and disappears when you close your browser. To use Vasuma without troubles you need to have cookies enabled.

The second type of cookie saves a file permanently on your computer. This type of cookie is used to track how visitors move around on the website. This is only used to offer visitors better services and support. The text files can be deleted. On Vasuma we use this type of cookie to keep track of your shopping cart and to keep statistics of our visitors. The information stored on your computer is only a unique number, without any connection to personal information.

Payment

All products remain Obermetalworks property until full payment is made. The price applicable is that set at the date on which you place your order. Shipping costs and payment fees are recognized before confirming the purchase. If you are under 18 years old you must have parents' permission to buy from Obermetalworks.

All transfers conducted through Obermetalworks are handled and transacted through third party dedicated gateways to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.

Additional Information

Obermetalworks reserves the right to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice. At the event of when a product is sold out, Obermetalworks has the right to cancel the order and refund any amount paid in the best way. Obermetalworks shall also notify the customer of equivalent replacement products if available.

RETURN POLICY

You are entitled to an exchange or refund within 3 business days of your purchase. Please note that the product must be returned unused, in original packaging including all tags. In case of refund neither the original shipping cost nor the return shipping cost will be repaid. You must contact us via e-mail for a return address.
